A shopper buys your best-selling kettle inside an AI assistant. The order arrives in your admin. Two weeks later, the kettle stops working. Who does the shopper contact? Do you have their email to answer? Will they see your brand when they buy a second one, or only the assistant's?
Every major agent channel announced in 2026 answers the first legal question the same way: the store remains the merchant of record. That is good news, but it is the start of the conversation, not the end. In this article, we look at what the platforms have promised, what merchant of record does and doesn't settle, and the five things to check before you turn a channel on.
This article is for information only and is not legal advice. Contract terms differ by platform and country; read the terms of each channel you join.
What the platforms say
- Shopify. When Shopify opened Agentic Storefronts to ChatGPT in March 2026, it said merchants "remain the merchant of record, retaining ownership of customer relationships and data." Orders flow into the Shopify admin with ChatGPT referral attribution, and merchant checkout customizations carry over.
- TikTok and Salesforce. For TikTok's Buy Direct, TikTok said the brand stays the merchant of record. Salesforce added that its Commerce Cloud merchants keep the shopper's contact details, purchase history and preferences, and handle post-purchase service and returns. We covered it in TikTok's Buy Direct and Shopping Assistant.
- OpenAI. Digital Commerce 360 reported in March 2026 that OpenAI was moving away from Instant Checkout inside ChatGPT's answers toward checkout through merchants' own ChatGPT apps. The details of who holds what in those apps depend on how each merchant builds them.
What merchant of record settles, and what it doesn't
Being the merchant of record means the sale is yours: you are the seller on the receipt, you collect the payment through your processor and you carry the obligations that come with selling, from consumer rights to returns.
It doesn't, by itself, settle:
- Whether you receive the shopper's contact details in a form you can use after the order.
- Whether you may market to that customer. Receiving an email for order updates is not the same as consent for marketing.
- Whether the shopper sees your brand, or only the assistant's interface, before and after the purchase.
- Whether you can see where the order came from in your own reports.
- Who the shopper turns to when something goes wrong.
Those are the parts of the customer relationship that decide whether an agent sale turns into a second order.
Five things to check before you switch a channel on
1. Customer data on the order. Look at a test order from the channel. Which fields arrive: name, email, phone, shipping address? Are they the shopper's real details or a relay address? Can you contact the customer about the order without going through the platform?
2. Consent. If the channel collects marketing consent, does it pass it to you, and in what form? If not, treat every agent order as order-only contact until the customer opts in on your own site or in your own emails.
3. Brand and checkout. Shopify says merchant checkout customizations carry over into ChatGPT's in-app browser. Check what the shopper sees on your channel: your store name, your return terms, your support contact. If the shopper can't tell who sold the product, they will contact the assistant, not you.
4. Attribution. Can you tell, in your own admin and analytics, which orders came from which agent channel? Shopify mentions ChatGPT referral attribution in the admin. For purchases that never load your website, such as those through Shop MCP, site analytics won't record them; see Shopify's Shop MCP and measuring the agent funnel.
5. After the sale. Who handles returns, cancellations and disputes, and through which system? Salesforce says its merchants handle post-purchase service and returns. Make sure your return terms are the same in every channel, and that the shopper gets them in writing. For disputes on agent purchases, see who pays when a shopping agent gets it wrong.
Defaults matter
Some channels switch on by default. Shopify's help center says all available channels have access to your products through Shopify Catalog by default, and that one setting also enrolls the store in new channels; the Shop app can't be switched off in that section. Decide channel by channel rather than inheriting a default, and check the answers above for each one.
Questions to send the platform
Before you sign up, send the channel's support or partner team a short list and keep the answers.
- Which customer fields do we receive on each order, and are they the shopper's own details?
- Do you collect marketing consent for us, and if so, how is it passed to us?
- What does the shopper see about our store before and after paying: name, return terms, support contact?
- How is the order marked as coming from your channel in our admin, and can we export that?
- Who receives a return request or a complaint first, and how does it reach us?
- Can we switch the channel off, and what happens to orders and listings when we do?
A platform that answers these clearly is easier to work with. One that can't answer them tells you something too.
The bottom line
"You remain the merchant of record" is the right starting point, and the major platforms have said it. But the customer relationship is made of smaller things: contact details on the order, consent, a visible brand, attribution and a clear path for after-sales service. Check each one before you open a channel, and write down what you find. That list is worth more than any announcement.
Specoria checks the parts of this that live on your own site: whether your business identity, return terms and support contact are machine-readable and consistent, so that any agent that sells your products can repeat them correctly. Start with a free readiness test.
